On July 23, the Equal Employment Opportunity Commission (EEOC) issued a notice of proposed rulemaking (NPRM) to stop filing requirements for the Employer Information Report (EEO-1), as well as its related recordkeeping and record preservation requirements for most employers [91 F.R. 46332, 7-23-26]. The NPRM covers the EEO-1, EEO-2, EEO-3, EEO-4, EEO-5, and EEO-6.
Employers with 100 or more employees and federal contractors with 50 or more employees are required to file an EEO-1 with the EEOC, which includes information on race, ethnicity, and gender by job category. Employers count employees for purposes of the EEO-1 during a “workforce snapshot period” between October 1 and December 31.
Comments should be submitted in writing on or before August 24 and should include a reference to RIN 3046-AB37.
