Texas Local Paid Sick Leave Updates

There have been recent developments regarding paid sick leave (PSL) in Texas cities, including Dallas and San Antonio. The PSL requirements in Austin remain on hold and have not taken effect.

The Dallas PSL ordinance took effect August 1, 2019. The Texas Public Policy Foundation has filed a lawsuit on behalf of businesses challenging the ordinance. The city has announced that, with the exception of the anti-retaliation provision, the ordinance will not be enforced until April 1, 2020. Small employers (with five or fewer employees) are not required to comply with the PSL ordinance until August 1, 2021.

A Texas district judge has approved an orderto delay the effective date of San Antonio’s PSL ordinance to December 1, 2019, from August 1, 2019. The city and group of businesses suing the city over the PSL ordinance both agreed to the delay to give the city time to amend the ordinance.

The Austin PSL ordinance remains on hold pending the outcome of a court case challenging the ordinance. State legislation that would have voided local PSL ordinances (a preemption bill) did not pass during the recent legislative session.
