PayrollOrg Asks Ohio Court to Accommodate Payroll in Processing Rules

PayrollOrg’s Government Relations Task Force Garnishments Subcommittee asked Ohio’s Scioto County Court to allow employers to separately file interim reports, answers, and payments in garnishment procedures in accordance with Ohio Revised Code (ORC) Chapter 2716. Currently, when answers and checks are not filed together, the court rejects the filing. This prevents payment of the debt, due to the checks being old.

Under ORC §2716.05, an employer must pay the employee’s withheld amount to the clerk of the court within 30 days after the end of each pay period with an interim report and answer that clearly identifies the case. The statute is specific on the information employers must include.

While payroll professionals understand it is easier for the court to receive documentation in the same package as the payments, this procedure creates unnecessary hardship for employers and delays processing of payments to creditors, PayrollOrg said.

Allowing concurrent but separate submissions promotes compliance, reduces processing errors, and ensures timely receipt of funds for creditors while protecting employers from unnecessary procedural risk.
