New York Wage Deduction Law Extended

On December 7, Gov. Andrew Cuomo signed legislation extending the expiration date for the New York wage deduction law concerning overpayments and permissible deductions from November 6, 2018, to November 6, 2020.The law permits employers to use wage deductions to recover overpayments due to errors or salary advances [A.B. 10615, L. 2018].

The law also adds additional categories of permissible wage deductions (with employee consent). Previously, employers were not permitted to use wage deductions to recover overpayments, pursuant to a 2010 New York Department of Labor opinion letter.
