APA Member to Serve on Louisiana Worker Misclassification Task Force

APA member Martha Pennington, Director of Payroll Operations for PEOPLEASE, will represent APA on a Louisiana task force to detect, investigate, and eliminate employee misclassification in Louisiana.

The Louisiana Senate passed S.R. 22, which authorized the task force to study and make recommendations for changes to state laws to minimize employee misclassification. The legislation specifically included an APA representative as one of the 13 members of the task force. In November, APA appointed Pennington as its representative.

In S.R. 22, state senators raised concerns about the impacts of misclassifying workers, including: (1) a significant reduction in state and local tax revenues; (2) denial of employee benefits, such as minimum wages, sick leave, unemployment benefits, and worker’s compensation; and (3) the potential for unfair competition between employers that properly classify and those that misclassify employees.

Through S.R. 22, state senators expressed an interest in gathering more information on misclassification to determine whether existing state laws should be changed and, if so, what those changes should be.
