USCIS Opens Second Comment Period for Form I-9

U.S. Citizenship and Immigration Services (USCIS) is accepting comments for the second time on the next revision of Form I-9, Employment Eligibility Verification [87 F.R. 40857, 7-8-22].

USCIS had an initial comment period that expired on May 31 (87 F.R. 18377, 3-30-22). The current version of Form I-9 expires on October 31, 2022.

Proposed Revisions

USCIS proposed a few revisions in the first comment period: compressing sections 1 and 2 from two pages to one; adding a link to acceptable List C documents; simplifying and reducing the instructions from 15 pages to seven pages; and updating Form I-9 so it can be completed on all electronic devices.

Another revision is to change section 3 to a Reverification and Rehire Supplement so employers will have three areas to enter reverifications and rehires within three years of the employee’s original Form I-9. Employers will be able to print the supplement only when needed.

Submitting Comments

Comments should be submitted electronically (include OMB Control Number 1615-0047 and USCIS-2006-0068 in the letter). Comments must be received on or before August 8.
