State and Local Paid Sick Leave Guidance for COVID-19 Vaccine

Several state and local agencies have issued guidance directing employers to allow employees to use paid sick leave (PSL) for COVID-19 vaccinations and recovery time, including California, Colorado, Massachusetts, Nevada, New Jersey, Oregon, and Chicago.

New York and Chicago have passed laws that directly cover paid time off for employees to receive the COVID-19 vaccine. Massachusetts is also considering similar legislation.

Remember that state and local PSL laws cover preventative care, which like includes receiving and recovering from vaccinations.
