Effective January 1, 2025, employers in New York will be required to provide employees with 20 hours of paid prenatal personal leave (PPPL) during any 52‑week calendar period [A.B. 8805-C, L. 2024]. PPPL may be taken in hourly increments and must be paid in hourly installments.
New York’s paid sick leave (PSL) law was amended to include PPPL, which must be provided in addition to regular PSL already required by law. PPPL is defined as leave taken for health care services received by an employee during pregnancy or related to pregnancy, including physical exams, medical procedures, monitoring and testing, and discussions with a healthcare provider related to the pregnancy.
The final law is different from the governor’s original proposal. In her State of the State address, the New York Governor called for an expansion of the state’s paid family leave program to include 40 hours of paid leave to attend prenatal medical appointments (before the birth of a baby).
