The California Labor Commissioner’s Office has issued guidance on the new pay schedule for agricultural workers that took effect January 1, 2019.
For the first year of the phase-in, agricultural workers at large employers (those with 26 or more employees) earn overtime pay for all hours worked over 9.5 hours in a day or over 55 hours in a workweek. Small employers (those with 25 or fewer employees) have until January 1, 2022, before the changes to daily and weekly overtime pay take effect.
The daily and weekly overtime pay will reach 8 hours in a day or 40 hours in a workweek by January 1, 2022, for large employers and January 1, 2025, for small employers.
