Last Day to Submit 2023 EEO-1 Report Is July 9

Employers have until July 9, 2024, to submit their Employer Information Report (EEO-1) Component 1 data to the U.S. Equal Employment Opportunity Commission (EEOC). July 9 is the failure to file deadline; the data was due on June 4. Eligible employers that miss the July deadline will be out of compliance.

The EEOC’s filer help desk is available to assist filers. The 2023 instruction booklet and file upload specifications are also available.

Who Must File

Employers with 100 or more employees and federal contractors with 50 or more employees are required to file an EEO-1 with the EEOC, which includes information on race, ethnicity, and gender by job category. Employers count employees for purposes of this EEO-1 report during a “workforce snapshot period” between October 1 and December 31. The EEOC uses this workforce demographic data for many purposes, including enforcement, analytics and research, and employer self-assessment.

Filing Is Mandatory

In May, EEOC filed lawsuits against 15 employers “for repeatedly failing to submit mandatory EEO-1 Component 1 data reports in prior years, including for reporting years 2021 and 2022.”
