The Equal Employment Opportunity Commission (EEOC) announced that collection of 2019 and 2020 Employer Information Report (EEO-1) Component 1 data will open on April 26 and close on July 19 [EEOC, Announcements, 4-6-21]. Eligible companies must first file and certify the 2019 EEO-1 Component 1 data, then file and certify the 2020 EEO-1 Component 1 data after the 2019 data is submitted.
How to Certify Filings
Companies must file EEO-1 Component 1 data for 2019 and 2020 if they were in business and met the filing requirements for that year. In the online filing system, companies will certify their 2019 filing first. If the company was not eligible in 2019, it will need to certify it was ineligible before filing for 2020. If the company was ineligible in 2020 but was eligible in 2019, it will need to file the 2019 EEO-1 data first, then certify it was ineligible in 2020.
Who Must File
Employers with 100 or more employees and federal contractors with 50 or more employees are required to file an EEO-1, which includes information on race, ethnicity, and gender by job category. Employers count employees during a “workforce snapshot period” between October 1 and December 31. The EEOC delayed collection of the 2019 data due to the COVID-19 pandemic and has extended the data collection period from 10 to 12 weeks to provide employers more time to file.
