The article, “Collecting Child Support from Independent Contractors,” written by APA Director of Government Relations Alice Jacobsohn, Esq., is featured in the January 2022 edition of the Child Support Report, a monthly e‑newsletter published by the federal Office of Child Support Enforcement (OCSE).
Tackling the sometimes-complicated issue of collecting child support from independent contractors, the article acknowledges that as the gig economy grows, more states are passing laws requiring employers to report independent contractors as new hires and to withhold and remit payments for child support.
For dealing with this issue, employers are urged to understand the internal processes involved at their companies, and then determine the type of contractor being used and how they are paid, which will impact whether withholding is necessary.
As these new laws become enacted, an awareness campaign would be helpful, with child support agencies helping employers and independent contractors understand what is required through media releases and educational sessions.
