Arkansas and Utah Latest States to Regulate Earned Wage Access Providers

Two states – Arkansas and Utah – recently enacted laws regulating earned wage access (EWA) providers.

Arkansas

Effective June 18, 2025, EWA providers in Arkansas will be subject to certain requirements. Providers will not be required to register with the state or obtain a special license in the state to operate but must avoid prohibited actions including charging an employee late fees or interest for failing to pay any outstanding amount owed [H.B. 1517, L. 2025].

Utah

Effective May 7, 2025, EWA providers in Utah will be subject to certain requirements and restrictions. EWA providers will be required to register with the Utah Division of Consumer Protection annually and pay a registration fee. A provider doing business on May 7 may continue to act as a provider but must comply with the law and submit a registration application by October 6, 2025 [H.B. 279, L. 2025].
